Refund & Cancellation Policy

This Refund and Cancellation Policy applies to all services provided byLukeny Photography we for clients who engage us for photography and videography services on-location throughout South Africa and beyond.

By booking our services, you ("the Client") acknowledge and agree to this policy.

1. Booking & Payment Terms
  • A non-refundable deposit of 20% (unless another amount is agreed upon) is required to confirm all bookings.

  • The remaining balance is due 7 - 3 days prior to the scheduled shoot date unless otherwise agreed in writing.

  • Bookings are not confirmed until the deposit is received.

2. Client-Initiated Cancellations
2.1 Cancellation Timeline
  • More than 30 days before the scheduled shoot:
    Full refund of any payments made, minus the non-refundable deposit.

  • 15 to 30 days before the scheduled shoot:
    50% of the total service fee will be refunded, minus any non-recoverable expenses already incurred.

  • Less than 15 days before the scheduled shoot:
    No refunds will be provided. At our discretion, we may offer partial refunds or apply payments toward a rescheduled date.

2.2 Non-Recoverable Costs

Non-recoverable costs may include, but are not limited to:

  • Travel and accommodation expenses already booked

  • Third-party service fees

  • Permits or location fees

  • Equipment rentals

  • Administrative or preparation time

2.3 Client No-Show

If the Client fails to appear at the scheduled time and location without reasonable notice or explanation, this will be treated as a last-minute cancellation, and no refund will be issued.

3. Rescheduling by Client

We understand that sometimes circumstances change. The Client may request to reschedule:

  • Requests made more than 14 days in advance:
    One reschedule allowed at no additional cost, subject to availability.

  • Requests made less than 14 days in advance:
    Rescheduling may incur an additional fee to cover lost booking opportunities and costs.

4. Photographer-Initiated Cancellations

In the unlikely event that we are unable to provide the agreed services due to circumstances beyond our control, including but not limited to:

  • Personal illness or injury

  • Equipment failure

  • Unsafe or hazardous working conditions

  • Severe weather

  • Travel restrictions or unforeseen emergencies

  • Force majeure events (natural disasters, acts of government, civil unrest, etc.)

We will make every reasonable effort to:

  • Reschedule the shoot at a mutually convenient date, OR

  • Provide a full refund of all payments made, excluding the non-refundable deposit, if rescheduling is not possible.

Our liability is strictly limited to amounts paid to us for the affected booking.

5. Delivery Issues & Dissatisfaction
5.1 Technical Failures

In the rare event that the shoot results in total data loss (e.g., corrupted files, equipment malfunction) and no usable content can be delivered, a full refund will be issued.

5.2 Creative Dissatisfaction

Photography and videography are creative services subject to personal taste. While we strive to meet client expectations, subjective dissatisfaction with artistic style or content does not qualify for a refund once services have been rendered and deliverables provided, unless we have failed to comply with the agreed deliverables in writing.

6. Digital Products & Print Orders
  • Due to the nature of digital files and personalized prints, no refunds will be given for delivered digital or print products, unless defective or not in accordance with the agreed specifications.

  • Clients are responsible for reviewing and approving proofs prior to final printing.

7. Compliance with South African Law

This Refund and Cancellation Policy is compliant with the South African Consumer Protection Act (CPA). Nothing in this policy intends to override your statutory rights.
